These Terms govern your use of DebSpence.com and any services purchased through it. Read them before you use the site or engage my services.
Acceptance
By using DebSpence.com, you agree to these Terms and to any updates posted here. If you don’t agree, stop using the site.
The 2-Listing Guarantee
This section applies only to clients who have purchased and paid for a done-for-you system build. It does not apply to free content, blog posts, books, or anything else on this site.
What is guaranteed
If you do not secure at least 2 listings within 3 months of your system going live, I will pay you $1,000.
Definitions
System going live means the date I notify you in writing that your build is complete and active. That date starts the 3-month clock. It is not the date you signed, paid, or started onboarding.
A listing means a fully executed listing agreement between you (or your brokerage, with you as the listing agent of record) and a seller, dated within the 3-month period. Expired, withdrawn, or cancelled agreements still count, provided they were executed during the period.
The guarantee period is the 3 consecutive months beginning on the system-going-live date.
What you have to do to qualify
The guarantee is void if any of the following are true:
- You did not complete onboarding, including providing the information, access, and approvals I requested, within the timeframes agreed at kickoff.
- You disabled, bypassed, materially altered, or stopped using the system during the guarantee period.
- You allowed any required third-party subscription or service to lapse during the guarantee period.
- Your real estate license was inactive, suspended, or revoked at any point during the guarantee period.
- You did not respond to leads routed to you by the system within a reasonable time. Reasonable time means the response windows we agreed to during the build.
- Your account with me is past due at the time of the claim.
- You did not work the leads the system delivered. The system creates and routes opportunities. It does not make calls, hold appointments, or sign agreements for you.
How to claim
Send written notice to deb@debspence.com within 30 days of the end of the guarantee period. Include:
- Your system-going-live date
- Confirmation that you secured fewer than 2 listings during the period
- Reasonable documentation of your activity in the system during the period
Claims submitted after 30 days are not eligible.
Payment
If your claim qualifies, I will pay $1,000 within 30 days of verifying it. This payment is the sole and complete remedy under this guarantee. It is not a refund of fees paid, and it does not terminate or modify any other part of our agreement.
What this guarantee is not
It is not a guarantee of income, commissions, closings, or business outcomes beyond the specific terms stated above. It is not transferable. It applies once per client, per engagement.
If you and I have signed a separate written services agreement, that agreement controls wherever it conflicts with this section.
Site Content and Programs
Content published on DebSpence.com, including blog posts, guides, books, videos, and free resources, is for educational and informational purposes. I make no promises about the results you’ll get from it, and nothing in it is legal, financial, tax, or brokerage advice.
This disclaimer applies to published content and free resources. It does not limit or override the 2-Listing Guarantee above, which applies to paid system builds under its own stated terms.
Your Responsibilities
Stay respectful. No harassment, spam, or offensive content.
Protect your login. If you create an account, keep your credentials private. You’re responsible for activity under your login.
Intellectual Property
My content. Text, video, logos, images, and materials on this site belong to me or are used with permission.
Your license. You may view and use my content for your own educational or informational purposes. You may not resell, republish, or redistribute it without written approval.
Systems I build for you. Configurations, workflows, and assets built specifically for your business are yours to use in your business. Underlying methods, frameworks, and templates remain mine and may be reused with other clients.
Content You Post
You own it. Comments, reviews, and anything else you post are yours, and you’re responsible for making sure they’re lawful and don’t infringe on anyone’s rights.
I can use it. By posting, you grant me a license to display, modify, and distribute that content in connection with running and promoting this site. If I share it publicly, I’ll credit you.
No Warranties
DebSpence.com is provided as is, without warranties of any kind, express or implied. I don’t promise the site or its services will always be available or error-free.
This does not limit the 2-Listing Guarantee above.
Limitation of Liability
To the fullest extent permitted by law, I am not liable for indirect, incidental, or consequential damages arising from your use of this site.
For paid services, my total liability is limited to the amount you paid me for the service in question, plus any amount owed under the 2-Listing Guarantee.
Indemnification
You agree to defend, indemnify, and hold harmless DebSpence.com, its owner, and its affiliates from claims, liabilities, and expenses, including legal fees, arising from your misuse of the site, your breach of these Terms, or your infringement of third-party rights.
Third-Party Links and Services
I may link to other sites and may build your system using third-party platforms. I’m not responsible for their content, availability, pricing, or privacy practices. If a third-party platform changes its terms, pricing, or functionality, that is outside my control.
Updates
I may update these Terms. Changes are posted here with a revised date. Continued use of the site means you accept the updated Terms.
Changes to the 2-Listing Guarantee do not apply retroactively. The version in effect on your system-going-live date governs your engagement.
Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Pennsylvania.
